"(5) The owner or operator of the solar facility, upon issuance of all final occupancy permits and approvals by the Township and any associated permitting agencies, shall provide a form of financial security satisfactory to the Township, in the form of a bond or a letter of credit, for potential use of decommissioning the facility.
(6) If the owner fails to remove or repair the vacated, abandoned or decommissioned solar facilities within the twelve (12) month period outlined above, the Township reserves the right to enter the property, remove the system, and use the financial security in place mentioned in Subsection K(5) above by the owner or pursue other legal action as may be necessary to have the system removed at the owner's expense.
(7) Any unpaid costs resulting from the Township's removal of a vacated, abandoned, or decommissioned solar system, if not covered by the financial security posted, shall constitute a lien upon the property against which the costs were charged. Each such lien may be continued, recorded, and released in the manner provided by the general statutes for continuing, recording, and releasing property tax liens.
(8) At the time of issuance of the permit for the construction of the large solar energy production facility, the owner shall provide financial security in form and amount acceptable to the Township to secure the expense of dismantling and removing said structures."
