"b) ... If the owner fails to dismantle and/or remove the PSES within the established timeframes, the County may complete the decommissioning at the owner's expense. c) At the time of issuance of the permit for the construction of the PSES, the owner shall provide financial security in the form and amount acceptable to the County to secure the expense of dismantling and removing said PSES and restoration of the land to its original condition, including forestry plantings of the same type/variety and density as the original. This amount shall be returned if the owner dismantles and removes the PSES to the satisfaction of the County. d) The facility owner or operator shall post and maintain decommissioning funds in an amount (100% or 110%) of the identified decommissioning costs, as adjusted over time. The decommissioning funds shall be posted and maintained with a bonding company or Federal or Commonwealth chartered lending institution chosen by the facility owner or operator and participating landowner posting the financial security, provided that the bonding company or lending institution is authorized to conduct business within the Commonwealth and is approved by Forest County."
